Exhibition of Draft Hawkesbury Section 7.12 Contribution Plan 2024
Council is inviting community members to view and comment on Council’s Draft Hawkesbury Section 7.12 Contribution Plan which will be on public exhibition for a period of 28 days from Monday 28 October to Monday 25th November 2024.
Hawkesbury City Council (Council) will experience development in the future that will have an impact on the quality and demand for local infrastructure provided by Council.
To meet the need for improvements of local infrastructure, Section 7.12 (Formerly Section 94A) of the Environmental Planning and Assessment Act 1979 authorises a Consent Authority to impose a condition of consent on a proposed development requiring the payment of a monetary contribution in the form of a levy of the percentage of the proposed cost of carrying out the development. The purpose of this plan is to authorise Council when granting consent to a development application, or an accredited certifier when issuing a complying development certificate to which this plan applies to require monetary contributions to be made towards the provision, extension or augmentation of local infrastructure provided by council.
This plan authorises Council or an accredited certifier to impose a condition of consent requiring a section 7.12 payment from developments that:
• Are not subject to contributions under a section 7.11 Plan or relevant Voluntary Planning Agreement adopted by Council, and
• Has a proposed development cost of $100,001 or greater and
• Not excluded under Section 2.6.1, 2.6.2 and 2.6.3 of the draft section 7.12 contribution plan.
The draft section 7.12 contribution plan has been prepared in accordance with the Environmental Planning and Assessment Act 1979, the Environmental Planning and Assessment Regulation 2020, and latest practice notes. Additionally, this plan provides the framework for the administration and operation of the determination, collection and management of contribution levies collected.
The draft section 7.12 contribution plan and other supporting documentation is on public exhibition from Monday 28 October to Monday 25th November 2024 and can be viewed on Council’s website at https://www.yourhawkesbury-yoursay.com.au/ under the documents tab on this page.
A hard copy of the draft section 7.12 contribution plan and other supporting documentation can also be viewed during the exhibition period at Council’s Administration Building, 366 George Street, Windsor from 9am to 4pm. Council will receive online submissions via www.yourhawkesbury-yoursay.com.au or in writing addressed to the General Manager by mail to Hawkesbury City Council, PO Box 146, WINDSOR NSW 2756, or email council@hawkesbury.nsw.gov.au(External link) up to close of business on 25th November 2024.
Confidentiality is not available to respondents. The details of any submissions may be included in a Council report where it may help to resolve issues raised in the submission. Information (including copies of submissions) may also be released in accordance with Council’s Access to Information Policy.
The inclusion of personal information with your submission is voluntary. However, if not provided Council will not be able to contact you about the proposal. The information will be stored in Council's electronic records system and paper files. For your protection, Council recommends that you do not include defamatory comments in your submission.
Under Section 10.4(5) of the Environmental Planning and Assessment Act 1979, any person who makes a submission to Council is required to disclose any political donation or gift. Where relevant a Political Donation and Gift Disclosure Statement is to accompany any submission lodged with Council. This statement can be obtained from Council’s Customer Service Unit or on Council’s website.
Any comments about this proposal may contain information that is personal information, such as information that identifies you, etc, for the purposes of the Privacy and Personal Information Protection Act 1988.
Submissions are balanced with Council’s statutory obligations, the rights of the proponent and the public interest. Council must consider any submissions made before it decides whether to proceed with or abandon a proposal.
